What is a Trademark Office Action?

A trademark office action is a refusal issued by the trademark office. The attorney found issues with your filing that must be addressed before your trademark application can register. It is very common for office actions to be issued. Most can be addressed with basic amendments to the application. Others require well-reasoned and lengthy legal briefs to persuade the trademark examiner that they overlooked important facts in their initial analysis.

How much does it cost for an attorney to file a response to a trademark office action?

Markavo offers two pricing tiers that apply based on the complexity of the issues raised in an office action.

For administrative issues that can be fixed with clarifications and amendments to the application, we charge a $125 legal fee for our Basic Office Action response service. Examples of administrative issues include disclaimers, color claims, clarifying goods and services and addressing minor issues related to ownership.

For Office Actions that present complex matters that typically require lengthy, well-reasoned legal briefs to overcome, we charge a $399 legal fee. Examples of complex issues include likelihood of consumer confusion, merely descriptive refusals, and trademarks that are found to be deceptive or generic.

How do I know if my trademark application has received an office action?

If a Markavo attorney filed your application, you will be notified about the issue and provided with options. If you filed the trademark application yourself, the trademark office will email you a notice to the address you used when filing the application.

How much time do I have to respond to an office action?

You have 3 months to respond. However, the sooner you respond, the sooner you will know if your trademark can be registered.

What happens if I do not respond to an office action?

If you do not respond to the office action within 3 months, your trademark application will be automatically abandoned.

How long does the trademark office take to review a response to an office action?

It really depends on how busy your assigned trademark examiner is and how complex your case is. Generally, the trademark office will make a determination within two weeks to a month of receiving a response.

Are there government fees to file an office action response?

No. There are no government filing fees to respond to an office action.
