Frequently asked questions about Markavo's Settlement Negotiation and Drafting Service

Updated over a week ago

Markavo addresses trademark disputes in two steps. First we attempt to find common ground with the other party. Then, if a settlement is agreed to in theory, the it is reduced to writing, binding both parties contractually. Legal fees are charged for each step so that you only pay for the services you need in your case.

Step 1: Negotiation a Settlement with the Settlement Negotiation Service

What is the Settlement Negotiation Service?

Many trademark disputes are settled out of court, as oftentimes both parties prefer to avoid the expenses associated with protracted litigation. Your attorney will work to find common ground between the parties and negotiate an agreement that is consistent with the requirements of trademark law.

How does the service work?

Your attorney will review the dispute in depth after reading all the available correspondence between the parties. Then, after speaking with you about potential terms of settlement, your attorney will contact the other party with a proposal.

How much does the Settlement Negotiation Service Cost?

We charge a flat fee of $499 to reach out to the other party and attempt to reach common ground.

After the parties agree in theory, what happens next?

Should both parties come to an understanding, the agreement should be reduced to writing, with the Settlement Drafting Service, described below

Step 2: Turn a Proposed Agreement into a Contract Between the Parties with the Settlement Drafting Service

What is the Settlement Drafting Service?

If both parties have agreed in theory to the terms of a potential settlement, it is essential to ensure that the agreement is fair to both parties. Experienced trademark attorneys will assist you in writing a settlement agreement or reviewing an agreement provided by the other party.

How much does the Settlement Drafting Service Cost?

We charge a flat fee of $499 to complete a review or write a Settlement Agreement.

What sort of terms are typically included in a settlement?

Every case is different, but there is a universal list of terms that should be included in every settlement agreement to ensure that common risks are accounted for. For example, what countries does the agreement apply to? What happens if one of the parties is sold or goes out of business? What happens if one of the parties would like to apply for a similar trademark in the future? Working with an experienced trademark attorney is the best way to ensure your business is protected, now and into the future.
