What is the Declaration of Use service?
This is the mandatory compliance filing required for trademarks registered/granted on or after August 10, 2018. You must file a Declaration of Actual and Effective Use within three months following the third anniversary of your trademark’s registration (grant) date by IMPI.

Important: This deadline is strict and non-extendable. Missing it results in automatic cancellation of your trademark registration.
What is the Trademark Renewal service?
Every 10 years your Mexico trademark must be renewed to maintain full protection. The renewal process requires both a Renewal Application and a Declaration of Use.

You will typically need both services at different times: the standalone Declaration of Use at year 3, and the full Renewal service at year 10 (which also satisfies the use declaration requirement at renewal time).
When exactly are these filings due?
Declaration of Use (Year 3): Within a strict 3-month window starting on the third anniversary of the IMPI registration/grant date. No grace period.
Trademark Renewal (Year 10+): Can be filed up to 6 months before expiration, with a 6-month grace period after expiration (late fees may apply).
Tip: Check your registration certificate or the IMPI database (acervomarcas.impi.gob.mx) for the exact registration/grant date. For Madrid Protocol designations, timing for the use declaration at renewal can vary slightly based on WIPO notifications — our team handles these nuances.
Do I need to provide proof of use (specimens)?
For the standard Declaration of Use filing (both at year 3 and with renewal), a formal declaration is generally sufficient. Evidence of use is not typically required for these specific filings, though you must be able to truthfully declare actual and effective use in Mexico for the covered goods/services. What happens if I miss a deadline?
Missed 3-year Declaration of Use: Automatic lapse/cancellation of the registration. Revival is difficult or impossible in most cases.
Missed renewal: Possible during the 6-month grace period, but with additional risks and potential late fees. Filing on time is strongly recommended.
