When do I need to file a trademark renewal in Mexico?
You must file the renewal application within the 6 months before the expiration date.
IMPI allows a grace period of up to 6 months after the expiration date. Applications filed during this grace period will still be processed.
If you miss the grace period, the registration lapses (caducidad). You would then need to file a completely new trademark application to regain protection.
What is the Declaration of Use (Declaración de Uso Real y Efectivo)?
Mexican trademark law requires owners to periodically demonstrate actual and effective use of their mark. There are two key requirements:
Standalone 3-Year Declaration
File this declaration within 3 months after the 3rd anniversary of the grant date. It must specify the exact goods/services in actual commercial use in Mexico.
Failure to file causes automatic lapse of the registration (caducidad de pleno derecho). Protection is then limited only to the items you declared.
Declaration at Renewal (Every 10 Years)
A declaration of use must accompany every renewal application. It must specify the specific products/services on which the mark is actually and effectively used in Mexico.
Use must be genuine (not merely token) and must occur in Mexico, either exactly as registered or with non-distinctive variations.
What are the fees for a Mexican trademark renewal?

What happens if I miss the renewal deadline or fail to file the Declaration of Use?
Missing the renewal grace period results in caducidad (lapse) of the registration. A new application would be required.
Failing to file the standalone 3-year Declaration of Use also triggers automatic lapse, with protection limited to declared goods/services only.
At renewal time, an incomplete or missing declaration of use may prevent approval or limit the scope of the renewed registration.

Do I need to prove use of my trademark in Mexico?
