How much time do I have to respond to an office action at IMPI in Mexico?
Applicants generally have two months, counted from the business day following the effective date of notification of the office action, to file a response with IMPI. This initial term can be extended by an additional two months (for a maximum total of four months) upon timely payment of the applicable extension fee (prórroga). No further extensions are permitted beyond this four-month window.
What happens if I do not respond to an office action?
If no valid response is filed within the initial two-month period or the paid two-month extension, IMPI will deem the trademark application abandoned. This results in the loss of the application’s priority/filing date, the archiving of the file, and the inability to proceed with that particular application. Any fees already paid are typically not refunded, and the mark may become available for third parties to register. To pursue protection afterward, a new application must be filed from scratch. In certain specific cases (such as failure to file a required declaration of use after renewal of an international registration designating Mexico), non-response to a related office action can lead to cancellation or lapse of the registration itself.
